Gold Wingnut Productions $10,000 Amenity Fee Giveaway Rules and Terms:



Purpose:

Gold Wingnut Productions LLC, is gathering data to validate or invalidate the claim of some residents of The Villages Florida that an agreement was made at the time of purchase between the homeowner and “The Villages” to limit the maximum Amenity Fee paid by residents to $155 per month for the duration of the resident’s homeownership, commonly referred to and as referred to herein as the “Deferral Rate”. The first ten (10) current residents of The Villages Florida who can provide valid legal documentation of such an agreement shall be eligible to receive up to $1,000 each to compensate them for the additional Amenity Fee paid each year. Payment and eligibility terms are provided below. It is the belief of Gold Wingnut Productions LLC that no evidence supporting this claim exists and that this is simply an urban legend of The Villages Florida but that this claim should be validated.  If these claims are validated, then Gold Wingnut Productions LLC shall award and make payments as described herein.



Terms of Entry and Eligibility:

1.    All persons who provide a response or documentation agree to the terms, conditions, and rules herein in their entirety and without exception or reservation. Failure to agree to the conditions as stated shall be terms for disqualification and forfeiture of any and all compensation provided herein.



2.   All persons providing valid legal documentation substantiating the claim of a maximum monthly Amenity Fee of $155 for the duration of homeownership in The Villages Florida agree to be party to any possible legal action(s) necessary to rectify the and restore the Deferral Rate.



3.   With respect to this event and the provided legal documentation, “The Villages”, shall refer to the Declarant as stated in the homeowners Declaration of Covenants, Conditions, and Restrictions agreed to when purchasing their home in The Villages Florida.



4.   All documents submitted to Gold Wingnut Productions LLC, shall become the property of Gold Wingnut Productions LLC and shall not be returned to the provider. Gold Wingnut Productions LLC, shall destroy or delete any document provided after announcement of the winners that do not provide support for the claim of a permanent Deferral Rate as described in this document.



5.   Only those valid contractual documents between the homeowner and “The Villages” that have been submitted as described herein shall be considered eligible for any monetary award.  Documents between the homeowner and any other party shall not be eligible for participation and/or award. Verbal and email statement or agreements are not eligible for participation and/or award.



6.   All submissions must be received by Gold Wingnut Productions, LLC. no later than 11:59 PM Eastern Time September 15^th 2020. All submissions must be provided to 10K@goldwingnut.com by the above listed deadline for consideration. No other entry or delivery method shall be considered valid or acceptable. Gold Wingnut Productions, LLC. is not responsible for any misdirected, later, or otherwise undelivered or unreceived entry or documentation.



7.   All submissions must include:

a.   An electronic copy of the entire legally executed contract document stipulating the agreement between the homeowner and “The Villages” to not require the payment of an Amenity Fee greater than $155 per month for the duration of ownership.

b.   The entrants full name

c.   The address of the residence of submission.

d.   The phone number of the entrant

e.   The email address of the entrant

f.    The date of purchase of the home

g.   Agreement to provide certified copies of the submitted documentation prior to October 1, 2020.

h.   A statement of agreement to all stated terms and conditions listed herein.

Any entry not having all items listed above shall be considered ineligible for participation and and shall be void.



8.   Gold Wingnut Productions, LLC will publicly announce the names of all winners on or about 1 October 2020.



9.   Additional eligibility requirements:

a.   The entrant must be a current resident of The Villages Florida.

b.   The entrant must have purchased the subject home prior to 1 October 2019 and the discontinuation of the Deferral Rate.

c.   The subject residence must be occupied full time or part time by the entrant. Any property used as a rental or income property currently or any time since purchase by the entrant, shall not be eligible for participation in this event.

d.   Only one entry per home in The Villages Florida shall be accepted.

e.   Employees or family members of The Villages of Lake-Sumter, Inc, or its affiliated companies, Community Development District Supervisors past, present, or future, Amenity Authority Committee members past, present, or future, and the District staff are ineligible to participate in this event.



10. Payment of winnings:

a.   Gold Wingnut Productions LLC shall pay each selected winner the difference between the Deferral Rate of $155 per month and the amount paid between 1 October 2019 and 30 September 2020 for the subject property Amenity Fee on or about 1 October 2020.

b.   The winner agrees to provide Gold Wingnut Productions LLC proof of the amount paid for the Amenity fee for the subject time period. The acceptable proof shall be a copy of the utility bill for the subject residence for the month in which the CPI adjustment is applied each year.  Each successive year a copy of the utility bill with the revised Amenity Fee rate shall be provided to Gold Wingnut Productions LLC.

c.   Gold Wingnut Productions LLC shall, on or about 1 October of each successive year, pay each of the 10 winners the amount of the difference between the Deferral Rate of $155 per month and the validated amount paid that year by the resident for that year. Annual payments will continue to an individual winner until said winner has received a total of no more that $1,000. Each winner’s payment amount is independent of any other winner’s payments. No one winner shall receive more that $1,000 in total payment from Gold Wingnut Productions LLC.

d.   All payments shall be made in arrears of costs incurred. No advance, “buy-out”, payments in full, or payments other than described herein shall be made.

e.   All payment to a winner shall stop if said winner becomes deceased, sell the subject property, rents or otherwise utilizes the property for income purposes, or no longer utilized the subject property as their primary residence while residing in The Villages Florida. Payments shall stop effective the 1 October preceding the change of eligibility; no prorated or partial payments shall be made by Gold Wingnut Productions LLC to any winner.

f.    In the event of a settlement of a legal action that restores the Deferral Rate to a winner the obligations of this agreement shall be considered complete and no further payments shall be made to the winners by Gold Wingnut Productions.



11. The terms of this event are exclusive under the control of Gold Wingnut Productions LLC and may be altered, changed, or the event discontinued all or in part solely at any time at the discretion of Gold Wingnut Productions LLC.



12. All disputes shall be subject to the laws of the State of Florida and Sumter County Florida. Any article of these terms found to be in contradiction or violation of any laws of the State of Florida shall be considered void and all surviving terms shall remain in force. Participants and entrants agree to settle any legal disputes with Gold Wingnut Productions LLC associated with this event in and only in Sumter County Florida.



13. The event is in no way associated with The Villages of Lake-Sumter, Inc. and any affiliated companies or corporations, the Sumter Landing Community Development District, the Village Center Community Development District, or any other Community Development District associated with the community known as The Villages located in Florida.



14. The decisions, including those of eligibility and acceptability of all persons and documents submitted to Gold Wingnut Productions LLC, shall be made by Gold Wingnut Productions LLC and shall be considered final. No appeal of any decision will be considered.



15. No other terms or conditions to this agreement or event shall apply unless implemented by Gold Wingnut Productions LLC.
